Terms of Service

1. Acceptance of Terms

By accessing or using Xhenry (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and Xhenry.

2. Eligibility

You must be at least 18 years of age to access or use this Platform. By using Xhenry, you represent and warrant that you meet this age requirement. We employ age verification mechanisms and reserve the right to terminate accounts that fail to meet this standard.

3. Nature of Service

Xhenry is an online classified advertising platform that allows registered users to post advertisements. Xhenry acts solely as an intermediary and does not provide, endorse, verify, or control the services advertised by its users. Xhenry is not a party to any agreement between users of the platform. The platform merely provides space for classified advertisements, similar to a newspaper classifieds section.

4. User-Generated Content & Liability

All advertisements, descriptions, images, and other content posted on the Platform are created and uploaded exclusively by individual users ("User Content"). Xhenry does not create, edit, or curate User Content.

  • Users are solely and fully responsible for the content they post, including its accuracy, legality, and compliance with all applicable laws.
  • Xhenry does not endorse any User Content and makes no representations or warranties regarding its accuracy, completeness, or legality.
  • By posting content, users represent and warrant that they own all rights to the content or have obtained all necessary permissions, and that the content does not infringe upon any third-party intellectual property rights.

5. Prohibited Content

Users are strictly prohibited from posting content that:

  • Involves or depicts minors in any capacity.
  • Promotes trafficking, coercion, exploitation, or any form of non-consensual activity.
  • Contains explicit nudity or pornographic material.
  • Infringes upon the intellectual property, copyright, trademark, or other proprietary rights of any third party.
  • Is defamatory, fraudulent, misleading, or deceptive.
  • Violates any applicable local, state, national, or international law.

Xhenry reserves the right to remove any content and terminate any account that violates these prohibitions, without notice or refund.

6. DMCA & Copyright Policy

Xhenry respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international frameworks. If you believe your copyrighted material has been used on this Platform without authorization, please see our DMCA Policy page for the takedown procedure.

7. Coin-Based Economy & Refund Policy

Xhenry operates a virtual currency ("Coins") system for publishing and promoting advertisements. Once coins are purchased and used, they are non-refundable. However, if an ad is incorrectly rejected due to a system error, the platform may issue a discretionary credit.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, XHENRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. XHENRY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO XHENRY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Xhenry, its officers, directors, employees, and agents from and against all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

10. Content Moderation

While Xhenry employs automated and manual content moderation tools, it is technically impossible to review every piece of User Content before it appears on the Platform. We rely on our community to report violations. Upon receiving a valid report, we will investigate and take appropriate action, including content removal and account termination.

11. No Endorsement

The presence of an advertisement on Xhenry does not constitute an endorsement, recommendation, or guarantee by Xhenry of the advertiser or the services described. Users interact with advertisers at their own risk.

12. Cooperation with Law Enforcement

Xhenry cooperates fully with law enforcement agencies investigating illegal activity. We will provide user data and records in response to valid legal requests, court orders, and subpoenas. Content involving the exploitation of minors (CSAM) will be immediately reported to the National Center for Missing & Exploited Children (NCMEC) and relevant Indian authorities including NCRB.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Modifications

Xhenry reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
